2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to purchase through the Service.

By completing checkout, you confirm that you meet these requirements and that the information you provide is accurate.

We may refuse or restrict transactions where reasonably necessary to prevent fraud, unlawful activity, or misuse, subject to applicable law.

3. Description of the Service

Make Someone Happy Or Not provides personalized, time-limited digital surprise experiences.

Customers select an available occasion or template, customize the permitted content, review the preview, and purchase a unique digital link.

The selected experience, total price (including applicable taxes), and link availability period are displayed before completing checkout.

Saved text and emoji selections are preserved in the delivered experience. Animations, visual effects, sound variations, and playback behavior may differ between previews, devices, browsers, or individual visits.

The Service provides a digital experience and does not guarantee any particular emotional reaction, response, or outcome from its recipient.

4. Customer Responsibilities and Preview Confirmation

You are responsible for reviewing the preview and verifying your submitted text, emoji selections, names, and other personalized information before completing payment.

By confirming the relevant checkout declaration, you acknowledge that the saved content reflects your intended selections.

You must ensure that you have the necessary rights or other lawful basis to submit and share any personal information or third-party content.

You must not include confidential, highly sensitive, or unlawful information in a surprise.

Corrections or changes after purchase are not guaranteed unless an editing feature is expressly provided. This does not affect your statutory rights where the delivered content differs from the agreed order.

5. Acceptable Use and Prohibited Activities

You must use the Service lawfully and respectfully. Our Acceptable Use Policy forms part of these Terms and sets out additional content and conduct restrictions.

In particular, you must not use the Service to threaten, stalk, bully, harass, defraud, impersonate others, violate privacy or intellectual-property rights, distribute malware or phishing content, or publish unlawful material. You must not use bots, scraping, guessing, enumeration or other techniques to discover surprise links without authorization, circumvent security controls, send unsolicited bulk messages, or disrupt the Service. Fraudulent exploitation of payments, coupons, refunds or technical vulnerabilities is also prohibited.

We may investigate reports and take lawful, necessary and proportionate measures, including removing content or restricting access. Any retention of evidence must have a lawful basis and follow applicable retention rules. Where required by law, we will provide notice, reasons and complaint or appeal options.

6. Orders, Prices, and Payment

All purchases are one-time transactions unless a different arrangement is expressly disclosed before checkout. No subscription or automatic renewal is created by a standard surprise-link purchase.

The total amount payable, including applicable taxes, is displayed before payment confirmation.

A valid 100% discount coupon reduces the amount payable to zero. Successful coupon redemption completes checkout without a card payment. Coupon availability may be limited by its validity dates, remaining redemptions or other conditions communicated with the offer.

Payments are processed on the active third-party payment provider's hosted page, currently Stripe or Worldline/Cardlink. The available cards and wallets depend on the provider and the options available for the transaction.

We do not store complete payment card numbers or card security codes.

Submitting payment information does not by itself confirm that a purchase has been completed. A paid order is activated following successful payment confirmation; a zero-price coupon order is activated following successful redemption.

Failed, cancelled, or unconfirmed payments do not ordinarily result in creation of a paid surprise link.

We may change prices for future purchases without retroactively increasing the agreed price of an existing order.

7. Digital Delivery

Following successful payment confirmation or valid coupon redemption, we normally activate the personalized digital surprise link and make it available on the checkout confirmation page immediately.

Digital delivery may occasionally be delayed by technical failures, security checks, or payment-verification issues.

Where a technical problem prevents delivery, customers may contact support for assistance and any remedies available under applicable consumer law.

We send an order email to the purchaser with an order summary, the surprise link and its expiry date. Email delivery can be delayed by the email service or technical processing. A receipt may be sent separately when receipt emailing is enabled; it is not attached to the surprise-link email.

The purchaser shares the surprise link with the recipient. The Service does not automatically email it to the recipient.

The order-summary email does not replace any additional contractual information or confirmation required by applicable law. The conditions governing withdrawal rights are explained below.

8. Withdrawal Rights, Cancellations, and Refunds

At checkout, the customer must actively select two separate required declarations, which are not preselected on a new checkout: one confirming age, preview review, acceptance of these Terms and reading of the Privacy Policy; and another expressly requesting immediate digital supply and acknowledging the loss of the statutory withdrawal right once supply begins, where the legal conditions for that loss are met. Acceptance of these Terms alone is not the separate express consent.

For digital content not supplied on a tangible medium, the statutory right of withdrawal may be lost once supply begins, provided all applicable legal requirements have been satisfied, including the required express consent, acknowledgment, and contractual confirmation.

Where the transaction legally qualifies as a service or involves continuing digital-service obligations, the applicable withdrawal rules may differ.

The checkout acknowledgement does not override mandatory law. The withdrawal right is not lost unless all applicable legal conditions have been satisfied.

Where the legal requirements for loss of the withdrawal right have been satisfied, we generally do not provide discretionary refunds after successful delivery merely because a customer changes their mind, no longer wishes to share the surprise, or is dissatisfied with the recipient's reaction. This does not prevent a refund or other remedy required by law.

Nothing in these Terms excludes mandatory consumer rights or remedies for non-delivery, defective digital content, or lack of conformity.

Refund requests and cancellation questions are handled in accordance with our Refund & Cancellation Policy and applicable law. If these documents conflict with mandatory law, mandatory law prevails.

9. Link Lifetime and Expiration

Unless a different duration is clearly displayed before checkout, a personalized surprise link remains available for 30 days following successful payment confirmation or valid coupon redemption. The access period starts when checkout is completed, not when the recipient first opens the link. Promotional links may have a different period communicated with the offer.

After expiration, access may cease permanently.

Expired links are not automatically renewed, extended, or restored.

We do not guarantee recovery of expired personalized content.

Expiration of a surprise link does not necessarily result in immediate deletion of all associated transaction or personal data. Applicable retention periods are explained in our Privacy Policy.

10. Sharing and Access to Surprise Links

Surprise links are accessible to anyone who possesses their unique URL, unless additional access restrictions are expressly provided.

Standard surprise links do not require a recipient password or account. Access is subject to the link remaining valid and the Service's security restrictions.

Recipients may copy, forward, photograph, screenshot, or otherwise share the experience.

Customers are responsible for choosing appropriate recipients and avoiding disclosure of confidential information.

We cannot guarantee that third parties will not redistribute or retain content after accessing a shared link.

We may implement technical measures to reduce unauthorized discovery and automated access, but no security measure guarantees absolute protection.

11. User-Submitted Content

Customers retain any intellectual-property rights they hold in their submitted content.

By submitting content, you grant the Service a limited, non-exclusive, royalty-free license to store, process, reproduce, display, transmit, and technically adapt that content as reasonably necessary to provide, maintain, secure, and support the purchased experience.

This license does not transfer ownership of your content to us.

You confirm that your content does not infringe the rights of others.

We do not routinely review every personalized submission before it becomes accessible through its link. Content reports are assessed manually. This does not remove obligations imposed by applicable law.

We may remove or restrict content where required or permitted by applicable law and these Terms.

12. Content Reporting and Moderation

If you believe that a surprise contains unlawful, abusive, infringing, or privacy-violating material, you may report it through our Contact page.

Reports should identify the relevant URL and explain the concern.

We will assess sufficiently detailed reports and may restrict or remove content where appropriate.

Where applicable, we will provide required notifications, explanations, and available complaint or appeal procedures.

We may take proportionate measures against repeated or serious misuse, subject to applicable law.

13. Intellectual Property and Service Materials

The Service's original software, website design, branding, templates, text, visual effects, graphics, and other protected creative materials belong to their respective rights holders.

Music and other licensed assets may be subject to additional third-party licensing conditions.

Purchasing a surprise grants a limited right to access and share the resulting digital experience for its intended purpose during the applicable availability period.

It does not transfer ownership of the underlying software, music, templates, or other protected materials.

You may not extract, redistribute, sublicense, resell, or independently commercially exploit those materials without the necessary authorization.

Nothing in these Terms restricts rights granted by applicable law.

14. Optional Promotional Permission

Purchasing a surprise does not authorize us to publish its personalized content in advertising, promotional materials, or social media. The Service does not automatically publish purchased surprises and does not currently collect promotional permission through a checkout checkbox.

Promotional use requires separate, optional permission where applicable.

Any permission is limited to the purposes and scope explained when requested.

Permission from a purchaser does not automatically authorize publication of another person's personal data, likeness, or copyrighted material.

We may anonymize content, remove identifying details, or seek additional authorization before publication.

Where consent is the applicable legal basis, it may be withdrawn for future processing through our Contact page.

15. Technical Requirements and Availability

The Service requires a compatible device, browser, and internet connection.

Certain features may depend on browser permissions, operating-system restrictions, network conditions, or third-party technologies.

Audio playback, sound volume, animations, and visual presentation may vary.

We take reasonable measures to maintain the Service but cannot guarantee that it will operate without interruption or temporary technical problems.

Maintenance, infrastructure failures, security incidents, or external service disruptions may affect availability.

These limitations do not remove statutory rights where the digital content or service is not supplied or does not conform to the contract.

16. Third-Party Providers

The Service may rely on external providers for payment processing, hosting, infrastructure, email delivery, analytics, and other operational functions.

Relevant personal-data processing is explained in our Privacy Policy.

Third-party technical failures may affect individual functions.

Our use of external providers does not exclude responsibilities imposed on us by applicable law.

17. Security and Fraud Prevention

We may use proportionate security measures to detect and prevent fraud, unauthorized access, abusive automation, payment misuse, and other threats.

These measures may include rate limiting, suspicious-activity detection, access restrictions, and relevant transaction or security records.

We may disclose relevant and lawfully retained information to payment providers or competent authorities where a lawful basis exists and disclosure is necessary and proportionate for dispute handling, compliance or fraud prevention.

Any processing of personal data is subject to applicable data-protection law and our Privacy Policy.

18. Payment Disputes and Chargebacks

Customers who experience payment or delivery problems are encouraged, but are not required, to contact support so that we can investigate and attempt to resolve the issue.

Where a payment is disputed, we may provide the payment provider with relevant and lawfully retained records, such as payment confirmation, order information, checkout acknowledgments, and digital-delivery records.

Customers retain their rights to dispute unauthorized or incorrect charges through their payment provider and to exercise any other rights available under applicable law.

Nothing in these Terms prevents lawful chargebacks, complaints, or consumer remedies.

19. Service Changes and Suspension

We may modify templates, effects, technical infrastructure, security features, and other aspects of the Service.

Changes will not unfairly remove essential features from an existing paid purchase.

Any modification affecting digital content or digital services supplied under an existing contract will comply with applicable consumer law.

We may restrict access or suspend content where reasonably necessary to address unlawful activity, serious misuse, security threats, or legal obligations.

Where applicable, customers will receive the required information and opportunities to challenge restrictions.

20. Limitation of Liability

To the maximum extent permitted by applicable law, we are not responsible for losses resulting solely from a customer's unlawful submissions, voluntary disclosure of a surprise link, or unauthorized redistribution by third parties where legal responsibility does not otherwise attach to us.

We do not guarantee a particular emotional, personal, or social outcome from use of the Service.

Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, or other liability that cannot lawfully be excluded or limited.

Nothing restricts mandatory consumer rights, including remedies for non-delivery or lack of conformity.

21. Privacy and Cookies

Personal information is processed in accordance with our Privacy Policy and applicable data-protection legislation.

Our Privacy Policy explains the categories of information collected, purposes and legal bases of processing, relevant recipients, retention periods, and available data-subject rights. Our Cookie Policy describes cookies and similar technologies.

Where required, non-essential cookies or similar technologies are used only after the necessary consent has been obtained.

22. Governing Law and Dispute Resolution

These Terms are governed by Greek law.

This choice of law does not deprive consumers of mandatory protections applicable under the law of their habitual country of residence where relevant.

Customers may contact us to seek an amicable resolution before initiating formal proceedings.

Nothing in these Terms restricts access to competent courts, authorities, or legally available consumer dispute-resolution mechanisms.

23. Changes to These Terms

We may revise these Terms to reflect legal, operational, or technical changes.

The Terms accepted at checkout apply to the relevant purchase. The application records the applicable Terms version with the order.

Material changes will be communicated where legally required.

Changes will not retroactively remove rights relating to purchases already completed.

24. General Provisions

If any provision is found invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

Failure to enforce a provision on one occasion does not automatically waive the right to enforce it later.

These Terms should be read together with our Acceptable Use Policy, Privacy Policy, Cookie Policy and Refund & Cancellation Policy. The Acceptable Use Policy forms part of these Terms; the privacy and cookie notices describe relevant data practices and rights.

Where mandatory law conflicts with these Terms, mandatory law prevails.
